HOLIDAY ROOMS, S.L. wants to transmit to its clients the maximum confidence guaranteeing the fulfilment of the current legislation. For this reason, it presents here the General Conditions of Contract, which will regulate the information provided by the website www.azaharbeach.com (hereinafter, the Website), as well as the commercial transactions between it and its users.

It will be understood that users who browse the website and purchase the corresponding products have accepted these conditions, although they may be modified by the owner of the website, without prior notice, when deemed necessary for its proper functioning. Having said that, the following GENERAL CONDITIONS are established as GENERAL CONDITIONS:

2. PURPOSE OF THE WEBSITE

This website offers information about the flats offered by AZAHAR BEACH, as well as the possibility to manage your reservation through it.

The information on each of them can be obtained by clicking on the corresponding links, although this website may remove, replace or change its content at any time.

In any case, everything offered through the website will be regulated by the general conditions in force at any given time.

3. WHAT ARE OUR PRICES?

The price of the reservation (including VAT) is indicated in each flat and will be calculated according to the season in which the reservation is made, the duration of the stay, the rate selected and the additional services contracted (parking, storage room…).

4. METHODS OF PAYMENT

Payment can be made by bank transfer and credit card through the virtual point of sale terminal.

However, the services that are not contracted through the web, can be contracted and paid for through the physical POS terminal once the stay has begun.

It should be noted that the card details are collected as a guarantee for the payment of the price.

5. PURCHASING PROCESS

1. On the home page, indicate the time period of the booking by selecting the check-in and check-out dates; then click on the blue “Search” button.
2. The different flats available will then appear. To find out more details about any of them, click on the “More Information” button. You will then see a summary of the flat booking (period of stay, number of guests and final price), as well as a detailed description of the flat and its features and services.
3. When you have found the flat you need, click on the “Book Now” button, which will take you to the booking form.
4. In this form you will be asked for the following data:

– Client/guest details: name, surname and contact details (telephone, address and e-mail), as well as the client’s ID number.
– Details of the trip: number of adults, children and/or babies, arrival time and, if applicable, flight number.
– Additional information considered relevant.
– Payment information: credit card number, CVC and indication of whether it is Visa or Mastercard, as well as the expiry date.

5. When all these details have been completed, click on the “Continue” button.

On the next screen you will see a summary of the booking details for confirmation, which will also be sent to the e-mail address indicated.

6. AVAILABILITY OF THE APARTMENTS

We only offer available flats, so it will not be possible to make a reservation if the requested location is already occupied.

However, and despite the fact that the website continuously updates its offer, if you request an occupied flat, you will receive an email informing you of the impossibility of the purchase and, where appropriate, of the possibility of acquiring another similar apartment (on a different date or with similar characteristics to the one requested).

All this without prejudice to the possibility of cancelling the reservation.

7. RIGHT OF WITHDRAWAL AND CANCELLATION POLICYPURCHASE PROCESS

Depending on the type of fare you have selected, the reservation may be cancelled under the conditions explained in the following link.

8. PROTECTION OF PERSONAL DATA

Pursuant to the provisions of current legislation on the Protection of Personal Data, we inform you that the data you provide us with through the booking process will form part of the processing for which HOLIDAY ROOMS, S.L. is responsible, for the purpose of managing requests for information, as well as the booking of the selected flats; they will also be used to find out your opinion, send satisfaction surveys and carry out statistical studies, as well as to inform you about services, activities or events promoted by HOLIDAY ROOMS, S.L. or in which it participates.

Your consent and the management of the reservation (with the application of the corresponding contractual measures) legitimise the processing of your data, which will be kept for as long as they are necessary for the indicated purposes and to meet the corresponding legal obligations (for example, in tax matters -5 years-; or, in the event that you make the reservation, the data in the BOOK OF ENTRY PARTS will be kept at the disposal of the Security Forces for three years).

Your data will not be disclosed to third parties, except for the communication of the tenants that the host or responsible for tourist accommodation must make to the police authority, in accordance with art. 25.1 of the Organic Law 4/2015, on the Protection of Public Safety, in relation to Decree 393/1974, and in other cases where a law or a judicial or administrative authority so requires.

You may exercise, at any time, the rights of access, rectification, deletion, opposition, limitation of processing and data portability by writing to info@azaharbeach.com with proof of your identity.

If you consider it appropriate, you may also file a complaint with the corresponding supervisory authority.

9. APPLICABLE LEGISLATION AND SUBMISSION TO JURISDICTIONS

The sale is understood to be made in Spanish territory, so that for any questions of interpretation or litigation may arise, will apply Spanish law and, in case of dispute, both parties agree to submit to the jurisdiction of the Courts and Tribunals of Nules, without prejudice to the provisions of consumer legislation where applicable.
