HOLIDAY ROOMS, S.L. wants to transmit to its clients maximum confidence, guaranteeing compliance with current legislation. Therefore, it presents here the General Contract Conditions, which will regulate the information provided by the website www.azaharbeach.com (hereinafter, the Website), as well as commercial transactions between it and its users.

It will be understood that users who browse the Web and purchase the corresponding products have accepted these conditions, although they may be modified by the owner of the page, without prior notice, when deemed necessary for its proper functioning. That said, the following are established as GENERAL CONDITIONS:

2. OBJECT OF THE WEB

This website offers information about the apartments offered by AZAHAR BEACH, as well as the possibility of managing your reservation through it.

You will obtain the information on each of them by clicking on the corresponding links, although this website may withdraw, replace or change its content at any time.

In any case, everything that is offered through the page will be regulated by the general conditions that are in force at any time.

3. WHAT ARE OUR PRICES?

The price of the reservation (which includes VAT) is indicated in each apartment and will be calculated based on the season in which the reservation is made, the duration of the stay, the selected rate and the additional services that you contract (parking, storage room… )

4. METHODS OF PAYMENT

Payment can be made by bank transfer and credit card through the virtual point of sale terminal.

Notwithstanding this, the services that are not contracted through the web, may be contracted and paid for through a physical POS once the stay has begun.

Note that the card details are collected as a guarantee for the payment of the price.

5. PURCHASE PROCESS

1. On the home page, indicate the time period of the reservation by selecting the arrival and departure dates; then click the blue “Search” button.
2. The different available apartments will appear below. To learn more about any of them, click on the “More Information” button. The summary of what the apartment reservation would be (period of stay, number of guests and final price) will then appear, in addition to offering a detailed description of the apartment and the elements and services it has.
3. When you have found the apartment you need, click on the “Book Now” button, which will take you to the form to formalize the reservation.
4. This form will request the following information:

– Client/guest data: name, surname and contact (telephone, address and email), as well as the client’s ID.
– Trip details: number of adults, children and/or babies, arrival time and, if applicable, flight number.
– Additional information considered relevant.
– Information for payment: credit card number, CVC and indication of whether it is Visa or Mastercard, in addition to the expiration date.

5. When all these data have been completed, press the “Continue” button.

On the next screen a summary will appear with the reservation data for confirmation, which will also be sent to the indicated email.

6. AVAILABILITY OF THE APARTMENTS

We only offer available apartments, so your reservation will not be possible if the requested location has been occupied.

Now, and despite the fact that the Web continually updates its offer, if it happens that you request an occupied apartment, you will receive an email in which you will be informed of the impossibility of the purchase and, where appropriate, of the possibility of acquiring another similar one. (on a different date or with similar characteristics to the one requested).

All this without prejudice to the fact that the reservation can be cancelled.

7. RIGHT OF WITHDRAWAL AND CANCELLATION POLICY PURCHASE PROCESS:

Depending on the type of rate you have selected, the reservation may be canceled under the conditions explained below:

7.1. 7.1. FLEXIBLE RATE (maximum 48 hours in advance to cancel):

-Active from January 7 to June 14 and from September 1 to December 22, except for Easter and long weekends.

Free cancellation up to 48 hours before the arrival date. Then 100% of the amount of the reservation will be charged.

7.2. 7.2. SEMI-FLEXIBLE RATE (maximum 14 days in advance to cancel):

-Active from June 15 to August 31, and from December 23 to January 6, as well as Easter and long weekends.

Free cancellation up to 14 days before the arrival date. Then 100% of the amount of the reservation will be charged.

7.3. 7.3. NON-REFUNDABLE RATE with 10% discount on other rates:

Prepaid, non-cancellable with the possibility of 1 date change*. In case of cancellation, 100% of the amount of the reservation will be charged.

*Conditions of the Date Change:

a. Only one date change per reservation is allowed.

b. The change of date is subject to availability and must be requested at least 5 days in advance of the original arrival date. Availability will be confirmed upon receipt of your change request.

c. The new selected date may not exceed 6 months from the initial one.

d. If the new selected date has a higher rate than the one originally reserved, you will be asked to pay the corresponding difference before confirming the date change.

e. If the new date selected has a lower rate than originally booked, no refund of the difference will be made.

f. Once the date change is confirmed, it will be considered definitive and no further changes will be allowed.

7.4. 7.4. LONG STAY RATE, for reservations of 4 nights or more, with a 15% discount on FLEXIBLE and SEMI-FLEXIBLE RATES:

-Active from January 7 to June 14 and from September 1 to December 22, except for Easter and long weekends.

Free cancellation up to 48 hours before the arrival date. Then 100% of the amount of the reservation will be charged.

APPLICABLE TO ALL RATES: In case of cancellation, the client will be refunded the amount of said reservation within the next 7 business days according to the cancellation policy.

8. PROTECTION OF PERSONAL DATA

By virtue of the provisions of the current regulations on the Protection of Personal Data, we inform you that the data you provide us through the reservation process will form part of the treatments under the responsibility of HOLIDAY ROOMS, S.L., with the purpose of manage requests for information, as well as the reservation of selected apartments; They will also be used to find out your opinion, send satisfaction surveys and carry out statistical studies, in addition to informing about services, activities or events promoted by HOLIDAY ROOMS, S.L. or in which you participate.

Your consent and the management of the reservation (with application of the corresponding contractual measures) legitimize the processing of your data, which will be kept as long as they are necessary for the indicated purposes and meet the corresponding legal obligations (for example, in tax matters -5 years -; or, in case you make the reservation, the data of the RECORD BOOK OF THE PARTIES OF ENTRY will be kept available to the Security Forces for three years).

Your data will not be transferred to third parties, except for the communication of the tenants that the host or manager of tourist accommodation must make to the police authority, in accordance with art. 25.1 of Organic Law 4/2015, on the Protection of Citizen Security, in relation to Decree 393/1974, and in other cases in which a law or a competent judicial or administrative authority so requires.

You can exercise, at any time, the rights of access, rectification, deletion, opposition, limitation of the treatment and portability of the data by writing to you, proving your identity to the mail info@azaharbeach.com.

If deemed appropriate, you can also file a claim with the corresponding control authority.

9. APPLICABLE LEGISLATION AND SUBMISSION TO JURISDICTION

The sale is understood to be made in Spanish territory, so for any interpretative or litigious questions that may arise, Spanish legislation will apply and, in case of dispute, both parties agree to submit to the jurisdiction of the Courts and Tribunals of Nules, without prejudice to the provisions of consumer regulations when applicable.
